Following is Proactive’s Privacy Policy. This Privacy Policy describes how Proactive collects, uses, processes, protects, and discloses information and personal data. Except as set forth in this Privacy Policy, we will not trade, sell, or disclose to any third party any form of PII (as defined below) without your consent and we will not disclose or make available any PII to any third parties seeking to market third party products without your consent.

Our Commitment to Data Privacy

As an IT solutions provider, maintaining and protecting private data is paramount, and a large part of our everyday focus. We are fully committed to protecting any data that is provided to us, including, but not limited to, personally identifiable information.

In order to operate efficiently for our prospects and clients, we need to gather data. This is a factor that allows us to serve our clients effectively. However, we only gather information that we feel is necessary to provide our services effectively or, to improve the experience of our prospects and clients.

We operate under the principles of ‘data minimization’ wherever possible, and only ask for the minimum amount of information required for us to provide our services effectively. We only retain and maintain data that we feel is necessary.

What We Mean by ‘Personal Data’

In this privacy policy, we will use the terms “Personally Identifiable Information”, “PII”, “information”, “sensitive information” and “sensitive data” interchangeably. All five terms refer to any information that allows us to identify you personally, and any information you choose to provide to us that fits that description. Examples of this include your name, email address, phone number, etc.

Other information we collect, such as your computer’s IP address or the general geographical location you are surfing from do not allow us to identify you directly, but we still consider this data under the umbrella of personal data when it comes to protecting your privacy and is treated as such.

Collection of Information

Proactive shall collect Personally Identifiable Information, including but not limited to name, physical address, email address, telephone number, billing and other personal information, from Clients when initiating service and in connection with the provisioning, support of products and services.

Proactive anonymously collects information about your visit when you use this website. We do not collect your electronic mail address or other personal information unless you actively submit that personal information to us or communicate with us through an electronic mail message. As is common with most websites and applications, when Visitors go on Proactive websites, Proactive may automatically receive and collect the Visitor’s information such as their IP address, browser or device type, and network routing information through tracking mechanisms such as cookies and click-throughs. Proactive may also make use of embedded URLs, pixels, widgets, buttons, web beacons, and social media buttons.

You may stop or restrict the placement of cookies on your computer, including third party cookies, or flush them from your browser by adjusting your web browser preferences, in which case you may still use our website, but it may interfere with or limit some of its functionality.

Use of Information

Proactive will use personal information to provide services and products requested by Clients and Visitors, market products and services to Clients and Visitors, and enable its vendors, contractors and partners to provide and assist Proactive in the marketing and provision of such services and products to Proactive, our Clients or our Visitors or to participate in joint marketing efforts, including marketing programs that provide preferential pricing on services and products. Personal information, non-personal information, and anonymous browsing information may be used to gather broad demographic information used in marketing, promotion, analytics, or similar activities. This information may be aggregated to measure the number of visits, average time spent, page views and other statistics about Users of a Site. If you purchase products and services offered jointly by Proactive and one of our partners, personal information may be received and shared by both Proactive and our partner. Each company’s privacy policy may apply. Proactive only works with partners whom we believe maintain high standards with respect to privacy and consumer rights. Proactive may also use and disclose personal information to investigate and help prevent potentially unlawful activity or activities that threaten the integrity of our service or network, as required by courts or administrative agencies or in connection with a sale, merger, or reorganization of Proactive’s business. We may be required to disclose personal information that we handle under the Privacy Shield in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

Services Data

For certain products, Proactive serves as a service provider to its Customers. In our capacity as a service provider, we will receive, store, and/or process data owned and/or controlled by our Customers. We retain your information for up to 10 years after your last transaction with us.

In such cases, we are acting as a data processor and will process the personal information on behalf of and under the direction of each particular Customer.

Services Data is distinguishable from Customer Data, because it is data and information that may reside on Proactive, Customer or Third-Party servers, desktops, or systems to which Proactive is provided access to perform its processing services. Services Data may include Third-Party Personal Information about a Customer’s employees, clients, customers, partners, agents, suppliers, or other individuals (collectively “Customer’s Parties”). Proactive treats Services Data as confidential in accordance with the terms of the Customer’s contract. Proactive is provided access to such information under the direction of its Customers, serves solely in the capacity of a data processor, and has no direct relationship with individuals that are Customer’s Parties.

Third Party Websites and Services

Our service may contain links to other websites and services not maintained by or subject to Proactive’s Privacy Policy. In addition, other websites and services may also reference or link to Proactive’s website. We encourage you to be aware of and read the privacy statements of each and every website and service that you visit. We do not endorse, screen, or approve, and are not responsible for the privacy practices or the content of, such other websites and services.

Data Security

Proactive uses reasonable efforts to maintain the security and integrity of sensitive data collected and stored by Proactive. Proactive has implemented physical and technical safeguards, online and offline, to protect Personal Information from loss, misuse, and unauthorized access, disclosure, alternation, or destruction. However, no system or service can give a 100% guaranty of security. Therefore, you acknowledge the risk that third parties may gain unauthorized access to your information when using or accessing our services and our network.

When we transfer your information to third party companies (e.g. analytics or web hosting vendors), we will ensure they maintain the same level of security as us. In cases of onward transfer to third parties of data of EU individuals received pursuant to the EU-US Privacy Shield, Proactive remains liable.

Please note that data that is transported over an open network, such as the Internet or e-mail, may be accessible to anybody. The Company cannot guarantee the confidentiality of any communication or material transmitted via such open networks.

Minors Privacy Policy

Proactive does not sell products or services for purchase by children. We do not knowingly collect personal data online from individuals who are under the age of 18. Proactive complies with the EU–U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union to the United States. Proactive is subject to the investigatory and enforcement powers of the Federal Trade Commission (FTC).

Proactive has certified to the U.S. Department of Commerce that it adheres to the Privacy Shield Principles. If there is any conflict between the terms in this Policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. Your California Privacy Rights (U.S. Only)

The Company reserves the right to change its Privacy Policy at any time without prior notice.
