Our Commitment to Data Privacy
As an IT solutions provider, maintaining and protecting private data is paramount, and a large part of our everyday focus. We are fully committed to protecting any data that is provided to us, including, but not limited to, personally identifiable information.
In order to operate efficiently for our prospects and clients, we need to gather data. This is a factor that allows us to serve our clients effectively. However, we only gather information that we feel is necessary to provide our services effectively or, to improve the experience of our prospects and clients.
We operate under the principles of ‘data minimization’ wherever possible, and only ask for the minimum amount of information required for us to provide our services effectively. We only retain and maintain data that we feel is necessary.
What We Mean by ‘Personal Data’
Other information we collect, such as your computer’s IP address or the general geographical location you are surfing from do not allow us to identify you directly, but we still consider this data under the umbrella of personal data when it comes to protecting your privacy and is treated as such.
Collection of Information
Proactive shall collect Personally Identifiable Information, including but not limited to name, physical address, email address, telephone number, billing and other personal information, from Clients when initiating service and in connection with the provisioning, support of products and services.
Proactive anonymously collects information about your visit when you use this website. We do not collect your electronic mail address or other personal information unless you actively submit that personal information to us or communicate with us through an electronic mail message. As is common with most websites and applications, when Visitors go on Proactive websites, Proactive may automatically receive and collect the Visitor’s information such as their IP address, browser or device type, and network routing information through tracking mechanisms such as cookies and click-throughs. Proactive may also make use of embedded URLs, pixels, widgets, buttons, web beacons, and social media buttons.
You may stop or restrict the placement of cookies on your computer, including third party cookies, or flush them from your browser by adjusting your web browser preferences, in which case you may still use our website, but it may interfere with or limit some of its functionality.
Use of Information
For certain products, Proactive serves as a service provider to its Customers. In our capacity as a service provider, we will receive, store, and/or process data owned and/or controlled by our Customers. We retain your information for up to 10 years after your last transaction with us.
In such cases, we are acting as a data processor and will process the personal information on behalf of and under the direction of each particular Customer.
Services Data is distinguishable from Customer Data, because it is data and information that may reside on Proactive, Customer or Third-Party servers, desktops, or systems to which Proactive is provided access to perform its processing services. Services Data may include Third-Party Personal Information about a Customer’s employees, clients, customers, partners, agents, suppliers, or other individuals (collectively “Customer’s Parties”). Proactive treats Services Data as confidential in accordance with the terms of the Customer’s contract. Proactive is provided access to such information under the direction of its Customers, serves solely in the capacity of a data processor, and has no direct relationship with individuals that are Customer’s Parties.
Third Party Websites and Services
Proactive uses reasonable efforts to maintain the security and integrity of sensitive data collected and stored by Proactive. Proactive has implemented physical and technical safeguards, online and offline, to protect Personal Information from loss, misuse, and unauthorized access, disclosure, alternation, or destruction. However, no system or service can give a 100% guaranty of security. Therefore, you acknowledge the risk that third parties may gain unauthorized access to your information when using or accessing our services and our network.
When we transfer your information to third party companies (e.g. analytics or web hosting vendors), we will ensure they maintain the same level of security as us. In cases of onward transfer to third parties of data of EU individuals received pursuant to the EU-US Privacy Shield, Proactive remains liable.
Please note that data that is transported over an open network, such as the Internet or e-mail, may be accessible to anybody. The Company cannot guarantee the confidentiality of any communication or material transmitted via such open networks.
Proactive does not sell products or services for purchase by children. We do not knowingly collect personal data online from individuals who are under the age of 18. If you become aware that an individual under 18 years of age has provided us with personal information, please contact us at email@example.com. If we become aware that an individual under the age of 18 has provided us with personal data without parental consent, we will take steps to remove the data as permitted by law.
Limitation of Liability
By using and visiting this website you agree that Company shall not be liable for any indirect damages, including, without limitation, lost profits, lost data, punitive, consequential and exemplary damages.
Proactive does not collect any sensitive data pertaining to medical or health conditions, race or ethnic origin, political, religious or philosophical affiliations or opinions, sexual orientation, or trade union membership. We ask that website visitors and clients not disclose sensitive data to Proactive.
Access to Your Personal Information
You may request that we limit our use of your Personal Information, including limiting use of your information for direct marketing purposes by emailing firstname.lastname@example.org.
Privacy Shield Framework
Proactive complies with the EU–U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union to the United States. Proactive is subject to the investigatory and enforcement powers of the Federal Trade Commission (FTC).
Proactive has certified to the U.S. Department of Commerce that it adheres to the Privacy Shield Principles. If there is any conflict between the terms in this Policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. Recourse and Enforcement
In compliance with the Privacy Shield Principles, Proactive commits to resolve complaints about our collection or use of your personal information. Individuals with inquiries or complaints regarding our Privacy Shield Policy should first contact Proactive at email@example.com.
With regards to personal information, or information collected in the context of an employment relationship, we will cooperate with the appropriate data protection authorities and comply with the advice of such authorities.
If you do not receive timely acknowledgement of your complaint, or if your complaint is not satisfactorily addressed, you can also submit your complaint to Privacy Trust, an independent third party. Visit https://www.privacytrust.com/drs/proactive to file a complaint.
You may have the option to select binding arbitration under the Privacy Shield Panel for the resolution of your complaint under certain circumstances. For further information, please see the Privacy Shield website (https://www.privacyshield.gov).
Your California Privacy Rights (U.S. Only)
Under Section 1798.83 of the California Code, residents of California have the right to request from a business, with whom the California resident has an established business relationship, certain information with respect to the types of Personal Data the business shares with third parties for those third parties’ direct marketing purposes, and the identities of the third parties with whom the business has shared such data during the immediately preceding calendar year. To exercise your rights, you may make one request each year by emailing us firstname.lastname@example.org with “Request for California Privacy information” on the subject line and in the body of your message. Be sure to provide in the request sufficient information to properly identify you and/or the members of your family.
